  • Last Will and Testament

    Unanticipated events can sometimes happen. If you pass on without a “Last Will and Testament,” then the State would oversee the distribution of your estate. Thus, having your estate properly planned out can give you and your loved ones some ease of mind.

    By making a Will, you can choose who inherits your property and belongings, or which organization your estate is left with. A Will can name the guardian you prefer to care for your minor children, and someone you trust to manage the property you leave to your minor children. Also, a Will can name the person you choose as an Executor, to ensure that the terms of your Will are carried out accordingly.

  • Advanced Medical Directive

    As part of your Estate Plan, you can include an Advance Medical Directive.

    This can provide instructions to your loved ones and medical professionals on your medical treatment preferences. Should you become incapacitated or incapable of speaking, an Advance Medical Directive will ensure that your wishes are followed accordingly.

    By crafting your own plan for medical care, this will spare your loved ones from having to make life-altering decisions for you. Also, this can ensure that the loved ones you select will have legal permission to make important medical decisions for you if that becomes necessary.

  • Power of Attorney

    A Power of Attorney form allows you to choose someone else to represent your best interests and make decisions on your behalf regarding your financial affairs.

    A Power of Attorney form can also be used to allow another person to act on your behalf for other matters. The Power of Attorney can authorize someone to act on your behalf immediately or only when you are incapacitated.

  • Trust

    A Trust is a legal tool that allows an individual (also known as a “Settlor”) to transfer their assets to the Trust, which is then managed by a Trustee designated by the Settlor. The Trustee thereafter distributes the assets to the beneficiaries according to the terms of the Trust.

    A Special Needs Trust (also known as a “Supplemental Needs Trust”) is a legal tool that can be used to provide for the financial needs of an individual who has a disability or special needs, without affecting their eligibility for government benefits, such as Medicaid or Supplemental Security Income (SSI).

    A Special Needs Trust can be established by a Settlor, which allows them to provide financial support for someone with a disability by transferring assets to the Trust. The Special Needs Trust can be funded with a variety of assets, including cash, investments, real estate, and life insurance policies.

    The assets in the Special Needs Trust are managed by a Trustee, who may use the funds to pay for expenses that are not covered by government benefits, such as medical expenses, education, housing, and transportation.
